Oregon Attorney Questions & Answers

I live in Washington County, but I was arrested while traveling in Clackamas County. Where will I be charged?

I practice in every county surrounding Portland and several others throughout the state of Oregon. Your charges are typically filed in the County where you were arrested.

I have been charged with a crime.  What can I do make sure my rights are protected?

Having a good lawyer you are comfortable with is a priority at my office.  A criminal charge is often scary and confusing.  Part of protecting yourself during this process is understanding what your options may be and what choices are available when a person is involved in the criminal system.

What is the difference between a misdemeanor and a felony?

Felony charges are the most serious charges.  The penalties and sanctions can be very severe, including large fines, probation or parole, and custody with the state corrections system.  Misdemeanor charges may not involve any state correction sanctions, but the penalties can still be long term.  An example could be long term suspension of driving privileges, county jail, or permanent criminal record.

Should I still seek an attorney if I am charged with a misdemeanor?

Every case is important.  My office prioritizes informing the client so that they can make all of his or her decisions with the most information available.

Won’t consulting with counsel make my charges more severe; will the State automatically think I am guilty because I want a lawyer?

A lawyer has an obligation to keep client communications confidential.  Unless the client consents, information related to your charges that you disclose cannot be shared.

How soon should I talk to an attorney?

Immediately.  Criminal charges are often the most serious set of circumstances in a person’s life. The sooner you learn the information specific to your situation, the less intimidating it becomes.
